Privacy policy (Application)

Welcome to dietgene, an online platform for personalized Diet recommendations (the “Service”). The Service is owned and operated by OME Care Ltd. (“Company”, “we”, “us”).

We respect your privacy. This Privacy Policy (the “Policy” ) explains our privacy practices for the Service we offer on our mobile application and Bot (the “Application”). The Policy also describes the rights and options available to you with respect to your personal information.

PERSONAL INFORMATION WE COLLECT

We collect the following information from users of the Application. This is also the information we have collected in the last 12 months.

Registration Information. The Service is available only to registered users. When you register to the Application, we collect your name and e-mail address.

Use Information. When you use the Application, we collect your gender, date of birth, weight, height, food allergies, genetic information, your answers to our health-related questions (medical conditions, health and activity information), data from your Apple health application. You may also log your food and exercise habits on the Application.

Analytics Information. We collect your browser type, operating system and IP address. We also use third party analytic tools such as Firebase to collect information on your usage and interaction with the Application.

This personal information is required to provide you with the Service. If you do not provide the personal information we ask for, it may prevent us from providing you with the Service or parts of it.

HOW YOUR PERSONAL INFORMATION IS COLLECTED

We collect most of your personal information directly from you.

When you register and use the Application, we collect the information specified above directly from you.

If you register to the Application with a third-party account, we receive your Identifiers from your third-party account. We may also receive personal information from other third-party applications upon receiving your consent.

You may register to the Application through a third-party account such as your Facebook or Google account. If you do so, we receive your Identifiers from your profile in the applicable account.

Upon receiving your explicit consent, we may collect activity and health information through third-party applications such as Apple health.

We collect your internet or other electronic activity information through third party analytic tools such as Firebase.

HOW WE PROCESS AND USE PERSONAL INORMATION

We process your Registration and Use Information to operate the Service and provide you with its features and functionality.

We process your Registration Information to send you updates and other communications related to the Service.

We process your Analytics Information to understand how users interact with the Service so that we can personalize, develop and improve it, and for security and monitoring purposes.

We will use your Registration Information to send you marketing communications about our services, including updates about new services that we believe may be suitable to you.

You may ‘opt-out’ of using your information for marketing communications by sending an email to: support@dietgene.com, or as otherwise provided in our marketing communications. By doing so, we will only delete the information which is required to contact you for marketing communications, while the rest of the Information you submitted to us which is necessary to provide you with the Service will continue to be processed and used.

WHEN IS YOUR PESONAL DATA SHARED WITH OTHERS

WE DO NOT SELL YOUR PERSONAL INFORMATION TO THIRD PARTIES AND HAVE NOT DONE SO IN THE LAST 12 MONTHS.

We will not share your personal information with third parties, except in the events listed below or when you provide us your explicit and informed consent. Listed below are the categories of third parties with whom we shared personal information in the last 12 months.

We share your information with our service providers helping us to operate the Service.	We share your personal information with service providers, who assist us with the internal operations of the Service. These entities are authorized to use your personal information only as necessary to provide their services to us and not for their own purposes.

Data Retention. We retain your personal information as long as you are a registered user of the Service. Thereafter, we will continue to retain your personal information as necessary to comply with our legal obligations, resolve disputes, establish and defend legal claims.

Data Security. We implement measures to reduce the risks of damage, loss of information and unauthorized access or use of information. However, these measures do not provide absolute security. Therefore, although efforts are made to secure your personal information, it is not guaranteed, and you cannot expect, that the Service will be immune from information security risks.

INTERNATIONAL DATA TRANSFER

The Service, by its nature as an online Service, may store and process information in various locations, including through cloud services. Accordingly, your personal information may be processed outside your place of residence. We will take appropriate measures to ensure that international transfer of personal information is done in accordance with applicable data protection law.

Protection Against Discrimination	You have the right to not be discriminated against by us because you exercised any of your rights under the CCPA. This means we cannot, among other things: Deny goods or services to you; Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; Provide a different level or quality of goods or services to you; or Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services. Please note that we may charge a different price or rate or provide a different level or quality of goods and/or services to you, if that difference is reasonably related to the value provided to our business by your personal information.
Designate an authorized agent to submit CCPA requests on your behalf	You may designate an authorized agent to make a request under the CCPA on your behalf. To do so, you need to provide the authorized agent written permission to do so and the agent will need to submit to us proof that they have been authorized by you. We will also require that you verify your own identity, as explained below.

We may ask you for additional information to confirm your identity and for security purposes, before disclosing the personal data requested to you, by using a two or three points of data verification process, depending on the type of information you require. If you have a password protected account for the Application, we may ask to verify your request through the account’s existing authentication methods. If you request that we disclose or delete your information, we will require you to re-authenticate with your account.

MINORS

The Service is not intended for minors under the age of 18. We do not knowingly or intentionally collect information from minors under the age of 18.

CHANGES TO THIS PRIVACY POLICY

From time to time we may change this policy, in which case we will notify you of the updated Policy by email. The latest version of the Policy will always be accessible on the Application.
